Fight over social media’s role in terror content goes to Supreme Court

The Supreme Court on Monday said it will hear a case that tests the limits of Section 230, the U.S. legal provision that protects social media companies from liability for what third parties post to their sites.

The high court’s decision in the case, which involves Google’s alleged responsibility for terrorist propaganda on its subsidiary YouTube, could have long-lasting ramifications for how internet sites treat users’ posts.

Twitter, Musk and Why Online Speech Gets Moderated

When the World Wide Web opened for public use in 1991, its enthusiasts proclaimed a new era of unfiltered free expression. That was before the internet in general, and social media platforms in particular, proved to be such effective places to spread misinformation about important matters such as Covid-19 and vaccines, disinformation (intentional falsehoods) about politics and elections, plus all manner of conspiracy theories and hate speech. Social media platforms have faced enormous scrutiny over which content it silences, and which it amplifies. The US Supreme Court is also getting involved.

The First Amendment to the US Constitution prohibits censorship by government, not censorship by private companies. In fact, like newspapers, book publishers and television stations, online gathering places such as Twitter and Facebook have constitutional protections to decide what to moderate and filter. Section 230 of the Communications Decency Act of 1996 gives them broad protection from the kinds of liability publishers traditionally face for defamatory content, along with broad leeway to moderate discussions and remove posts or leave them alone.

Facebook uncovers dozens of fake Chinese accounts trying to influence midterms

A report from Facebook's parent company Meta said fake accounts were impersonating Americans, attacking politicians from both parties and making divisive posts on issues like abortion and gun rights.

This was the first Chinese network we disrupted that focused on U.S. domestic politics ahead of the midterm elections ..." Meta said in a news release. "Chinese influence operations that we’ve disrupted before typically focused on criticizing the United States to international audiences, rather than primarily targeting domestic audiences in the U.S."

Another TikToker arrested in Egypt

Egyptian security authorities arrested popular TikToker Ibrahim Malik on charges of “promoting immoral content.”

According to a Sept. 28 report published by El-Balad, Malik was known for going live on TikTok with girls and women from Egypt and other Arab countries asking them to do various challenges. The report claimed Malik would disrespect and insult these women and their followers, for which many TikTok users criticized and ridiculed him.

Supreme Court Takes Up Challenge to Social Media Platforms’ Shield

The Supreme Court agreed on Monday to decide whether social media platforms may be sued despite a law that shields the companies from legal responsibility for what users post on their sites. The case, brought by the family of a woman killed in a terrorist attack, argues that YouTube’s algorithm recommended videos inciting violence.

The case, Gonzalez v. Google, No. 21-1333, concerns Section 230 of the Communications Decency Act, a 1996 law intended to nurture what was then a strange and nascent thing called the internet. Written in the era of online message boards, the law said that online companies are not liable for transmitting materials supplied by others.

Meta Probe Into 533 Million-User Data Leak Draws to a Close

Meta Platforms Inc. could face a hefty fine as a probe by a key European Union privacy watchdog into the leak of the personal data of more than half a billion users last year draws to a close.

The Irish Data Protection Commission submitted its draft decision in the investigation for approval to its EU counterparts, it said in a statement on Monday. Meta is among a number of big US tech companies that have set up an EU hub in Ireland, making the watchdog there its main supervisor for possible data protection violations

New Zealand P.M. Jacinda Ardern Peddles Government Censorship to an International Audience | October 03, 2022

Her address then turned to promoting the Christchurch Call to Action, an international initiative she co-founded with France's President Emmanuel Macron with the goal "to eliminate terrorist and violent extremist content online," according to its founding document.

At the U.N., Ardern briefly acknowledged free-speech concerns, before waving them away as less important than the dangers of unregulated speech. By her words, this category encompasses promotion of terrorism, undefined extremism, disinformation, and also ideas the powers-that-be find threatening.

What is T&S?

Great question (and one the industry hasn’t fully agreed upon). Think of Trust & Safety as the organization that protects social media and Big Tech companies and users from online abuse. As long as users are able to generate content online, time has told us that a minority of these users will create content that is offensive, scandalous, fraudulent, disingenuous, misinformative, hateful, spiteful, and harmful. T&S fights this with flexible policies, resilient operations, and informed detections.

Is T&S interesting?

That depends. If you enjoy stopping bad actors and keeping good people safe, then you’ll love T&S. It requires understanding new technologies and staying on top of breaking issues across society and the world. It also pays Big Tech salaries (no coding skills required).

How do you get into T&S?

That’s the tricky part. The short answer is: not easily. Most T&S orgs are part of Big Tech and (as a result) pay extremely well, so jobs are highly competitive. If you don’t know someone in the industry who can help refer you in, then you can learn more about T&S policies, current events, issues, regulations, and jobs at to improve your hiring chances and start doing meaningful work that helps people.
